Open Access: Are You Breaking the Law by Trying to Promote Your Published Content?

As discussions continue surrounding Open Access Week, IGI Global examined a critical aspect of Open Access models that is often overlooked – copyright laws.

Open access provides individuals and institutions unrestricted access to content published in scholarly, peer-reviewed publications, but even open access articles come with restrictions.

Prof. Tom Kwanya at the Technical University of Kenya and editor of the Handbook of Research on Managing Intellectual Property in Digital Libraries states, "Open access articles can be used with or without limited restrictions."

Prof. Adeyinka Tella at the University of Ilorin, who is also an editor of the Handbook of Research on Managing Intellectual Property in Digital Libraries, mentions, "It is important to note that copyright protects the way an idea is presented, rather than an idea itself; for instance, if it is committed to paper or other piece of media. So, what makes having copyright protection so important? Surely if it happens automatically you don’t have to worry about it? While it’s true that your work gets automatic protection, that doesn’t mean that people won’t copy your work for their own gain. Your copyright may be worth more than you think, so it’s important to properly consider the reasons for keeping on top of your property."

But what is the key difference between copyright protection and open access?

Kwanya mentions, “The main difference between copyright and open access licenses is the fact that the former does not allow others to benefit commercially from an original work while the latter may sometimes allow commercial use of original works.”

Not only is the distinction between copyright and open access significant, but it is also essential to understand how copyright laws concerning open access are executed.

Kwanya further elaborates by stating, "The closest way of enforcing copyright over open access works is through diverse licensing regimes. Of these, the creative commons is the most recurrent.”

At IGI Global, all of its hybrid open access journals offer authors the Creative Commons Attribution 4.0 International (CC BY 4.0) licensing arrangement for all open access articles. In the case of open access articles, the copyright remains solely with the author of the paper.
