Abstract:

This chapter aims to analyze the current European Union legislation on digital copyright from the perspective of the public interest in scientific research, by studying the digital exclusive rights framework granted to creators and to database owners and by contraposing it with the foreseen narrow field of public interest-based limitations on exclusive rights. The chapter concludes by identifying the necessity to redefine a new internal balance of copyright law which can respect authors' and database owners' legitimate economic interests and simultaneously promote the dissemination and the access to works for scientific research, publishing purposes, and the renewal of the creative cycle.

Prof. Pedro Pina is a lawyer and a law teacher at the Polytechnic Institute of Coimbra - ESTGOH, in Portugal. He holds a law degree from the University of Coimbra Law School and a post-graduate degree in Territorial Development, Urbanism, and Environmental Law from the Territorial Development, Urbanism, and Environmental Law Studies Center (CEDOUA) at the University of Coimbra Law School. He holds a master in Procedural Law Studies from the University of Coimbra Law School and is currently a Ph.D. student in the doctoral program "Law, Justice, and Citizenship in the Twenty First Century" from the University of Coimbra Law School and Economics School.
